A cricket or saddle flashing is important when the chimney structure is 30″ or wider so it can divert water away from the chimney. This is a water heater defect. The discharge tube has been cut off and now, if the water pressure builds up to a point that it must discharge, if anyone is in the area, they will get scalded by the hot water in the water heater. This is a safety issues and needs to be repaired.
